Abiding By Florida Landlord & Tenant laws

These are in place for both the protection of the landlords’ physical property, rights and the tenants’ property and associated rights. Adhering strictly to these laws is a must but they are not grievous.These laws can also benefit you greatly no matter if you are tenant or property owner. When either fail to comply whether intentionally or because of being unaware, the penalties can be rather severe. Just one more reason to choose a professional property management company.

Anti-Discrimination Laws

These laws are of paramount importance and can certainly attract some negative attention and hefty penalties.The list you cannot discriminate against could grow at anytime and is likely not to get shorter. In a nutshell just don’t discriminate and be sensitive in all interactions.The list currently includes but is not limited to family status, gender, mental disability, national origin, race or religion etc.

Some of the other Rules to be adhered to

  1. HOA guidelines and background checks when applicable.

  2. State, county and city guidelines.

  3. Completing and using a legally binding lease/ rental contract.

  4. Making all legal disclosures that apply.

  5. Providing and maintaining a habitable property to the tenant.

  6. Non-retaliation if the tenant exercises or questions a right.

  7. Laws governing depositing security deposits.

  8. Laws and guidelines pertaining to security deposits retention or disbursement.

  9. Evictions and their timelines, communications and legal proceedings.

  10. Many more are not shown.

Obviously, this is a very short list and it would take hundreds of pages to show them all.Our experiences with tenants and adherence to these laws makes un an invaluable resource.There is a reason professionals must be licensed and insured. Here is a really good example. I repeat it often because it is simply so true.I have also experienced it first-hand as a home owner/ landlord before becoming licensed.
